Issue Summary - Geneva Conventions POW Treatment
The Geneva Conventions (1949) and the two Additional Protocols (1977) form the foundation for international humanitarian law in times of war. The treaty focuses on the treatment of enemy forces as well as civilians living in occupied territories. These international treaties are intended to limit the barbarity of war by protecting non-combatantsââ¬âcivilians, medics and aid workersââ¬âand combatants who are no longer able to take part in battleââ¬â wounded, sick and shipwrecked troops, and all persons held as prisoners of war. The Conventions and their Protocols provide measures for preventing all violations and contain strict rules for dealing with the perpetrators of war crime atrocities known in the treaties as ââ¬Å"grave breaches.â⬠Under these rules, war criminals are to be investigated, sought, extradited if necessary, and tried, regardless of their nationality.à History and Background of Limiting War As long as there has been armed conflict, man has tried to devise ways to limit wartime behavior, from the sixth century BCE Chinese warrior Sun Tzu to the 19th century American Civil War. The founder of the International Red Cross, Henri Dunant, inspired the first Geneva Convention, which was designed to protect the sick and wounded. Pioneer nurse Clara Barton was instrumental in U.S. ratification of that First Convention in 1882. Subsequent conventions addressed asphyxiating gases, expanding bullets, the treatment of prisoners of war, and treatment of civilians. Nearly 200 countriesââ¬âincluding the United Statesââ¬âare signatory nations and have ratified these Conventions. Treatment of Combatants, Civilians, and Terrorists The treaties were initially written with state-sponsored military conflicts in mind and emphasize that combatants must be clearly distinguishable from civilians. Combatants who fall within the guidelines and who become prisoners of war must be treated humanely. According to the International Red Cross: Captured combatants and civilians who find themselves under the authority of the adverse party are entitled to respect for their lives, their dignity, their personal rights and their political, religious and other convictions. They must be protected against all acts of violence or reprisal. They are entitled to exchange news with their families and receive aid. They must enjoy basic judicial guarantees. Enemy Combatant Habeas Corpus Under these rules, captured enemy combatants, whether soldiers or saboteurs, may be detained for the duration of hostilities. They need not be guilty of anything; they are detained simply by virtue of their status as enemy combatants in war. The challenge in wars like those Afghanistan and Iraq is determining which persons who have been captured are terrorists and which are innocent civilians. The Geneva Conventions protect civilians from being tortured, raped or enslaved as well as from being subjected to attacks. However, Geneva Conventions also protect the uncharged terrorist, noting that anyone who has been captured is entitled to protection until their status has been determined by a competent tribunal. Military lawyers (Judge Advocate Generals Corps - JAG) reportedly have petitioned the Bush Administration for prisoner protection for two yearsââ¬âlong before Iraqs Abu Ghraib prison became a household word around the world. Supreme Court Ruling The Bush Administration held hundreds of people at the Guantanamo Bay naval base on Cuba, for two years or longer, without charge and without redress. Many were subjected to actions that have been characterized as abuse or torture. In June 2004, the U.S. Supreme Court ruled that habeas corpus applies to detainees at Guantanamo Bay, Cuba, as well as to citizen enemy combatants held in continental U.S. facilities. Therefore, according to the Court, these detainees have the right to file a petition asking that a court determine if they are being held lawfully.

Politics of Western Europe BLOOD AND BELONGING This is a critique of the book, Blood and Belonging, by Michael Ignatieff. This paper will explain the subject of the book and its relevance, discuss Michael Ignatieff's methods and conclusions on the subject and finally include a personal critique of the book by the author of this paper. The author of the book travels on what he terms "the six journeys." On these "journeys" he encounters different cultures, as he travels to six different coinciding areas of the world. He examines the unique expression of nationalism that each populace displays by interviewing various members of that particular society. The six areas that he travels to are specifically chosen for the clarity which nationalism is expressed in society. Nationalism is a factor contributing toward both present possible future instability in these areas. These areas are former Yugoslavia (specifically Croatia and Serbia), Germany, Ukraine, Quebec, Kurdistan and Northern Ireland. According to Ignatieff, in Croatia and Serbia there is a desire for a separate identity between the two nations. The fear of losing one's national identity has caused ethnic hatred. A terror so strong and historically persistent, it has driven people to a desperate state to do anything. This is a large contributor to the reasons for the extreme violence present there today. The author states, "A Croat, thus, is someone who is not a Serb. A Serb is someone who is not a Croat." This quotation profoundly expresses the short-sighted mentality present in their conflict. In his travels in Germany, the author points out an important question. Does the nation make the state, or the state the nation? This question by far does not stop here, especially when Germany is the subject. The essence of the German people is seen by some as aggressive and offensive, thus the existence of the German problem. If the nation makes the state then Germany will always be a threat. If the state makes the nation, then the aggressive nature of the German nation, which lead the world into two global wars, can be harnessed and redirected. The question has its roots and answers in the recent reunification of Germany. The Ukraine is concerned with not being Russian. It is here Ignatieff receives a complete vision of what nationalism is. He states, "I understand what nationalism really is: the dream that a whole nation could be like a congregation; singing the same hymns, listening to the same gospel, sharing the same emotions, linked not only to each other but to the dead buried beneath their feet." Quebec is a model that presents a possible future of the state system. Ignatieff uses the example of Quebec to illustrate the relationship between nationalism and federalism. He implies that "if federalism fails in Canada it can fail anywhere." If the balance between "ethnic and civil principles" is not maintained in Canada, who is not an impoverished country and has a large, successful economy; then perhaps the modern world has not transcended the grasps of nationalism. The Kurds represent a nation without a state, who find themselves surrounded by other nations who are more aggressive nationalists. The term Kurdistan is a definition of the areas used by Ignatieff to explain the area of major Kurdish populace concentration. There is no real borders, no flag, no government and Kurds must acknowledge the state in which they reside (i.e., - Syria, Turkey, Iran and Iraq), of which, is not Kurdistan. Finally, the sixth journey ends in Northern Ireland. He makes the observation that this is the ideal place to conclude his project. Northern Ireland contains a recurrence of the themes that seemed so prevalent in the other journeys. In Ireland ethnicity, religion and politics are all bound into one expression or identity. These are also evident in the five previous studies. Is Michael Ignatieff's work relevant? The answer to this question is, yes it is. The issue is important. His mother, Marjorie, was the Countess of Carrick, descended from the Irish King Brian Boru. His sister Isabel became the Queen of Norway by marrying King Eric II, long before Robert ascended to the Scottish throne. Robertââ¬â¢s grandfather, also named Robert, was the 5th Earl of Annandale. In the autumn of 1290, Margaret, the Maid of Norway, who was the seven-year-old heiress to the Scottish throne, died at sea. Her death set off a whirlwind of disputes regarding who should succeed to the throne, and the 5th Earl of Annandale (Roberts grandfather) was one of the claimants. Robert V, with the aid of his son Robert VI, captured a number of strongholds in the southwest of Scotland during the period between 1290 ââ¬â 1292. Naturally, young Robert supported his grandfatherââ¬â¢s claim to the throne, but ultimately, the role of king was given to John Balliol. Corbis via Getty Images / Getty Images Association With William Wallace King Edward I of England was known as the Hammer of the Scots, and worked diligently during his reign to turn Scotland into a feudal tributary state. Naturally, this did not sit well with the Scots, and soon Edward found himself having to deal with uprisings and rebellions. William Wallace led a revolt against Edward, and Robert joined in, believing that Scotland needed to remain independent of England. The Battle of Stirling Bridge, in September 1297, was a devastating blow for the English. Shortly afterwards, Bruce family lands were sacked by Edwards troops in retaliation for the familys role in the rebellion. In 1298, Robert succeeded Wallace as one of the Guardians of Scotland. He served alongside John Comyn, who would become his chief rival for the countryââ¬â¢s throne. Robert resigned his seat after just two years, when the conflicts with Comyn escalated. In addition, there were rumors that John Balliol would be restored as king despite his abdication in 1296. Instead, Scotland functioned without a monarch, and under the guidance of the countrys Guardians, until 1306, one year after Wallace was captured, tortured, and executed. Rise to the Throne In early 1306, two very important events took place that would shape the future of Scotland. In February, matters came to a head between John Comyn and Robert. During an argument, Robert stabbed Comyn at a church in Dumfries, killing him. When word of Comynââ¬â¢s death reached King Edward, he was livid; Comyn had been distantly related to the king, and Edward saw this as a deliberate plot to stir up dissent. Comynââ¬â¢s son, John IV, was immediately whisked off to England for his own safety, and put into the care of a nobleman who was raising Edwardââ¬â¢s own children. John Comyn was stabbed by Robert the Bruce in 1306. Print Collector / Getty Images Just a few weeks later, at the beginning of March, Robertââ¬â¢s father, the 6th Earl of Annandale, died. With his father now dead, and Comyn also out of the way, Robert was the chief claimant to the Scottish throne. He moved rapidly to take power. Robert was crowned king on March 25, but an attack by Edwardââ¬â¢s army pushed him out of the country. For a year, Robert hid out in Ireland, raising a loyal army of his own, and in 1307 he returned to Scotland. In addition to battling Edwardââ¬â¢s troops, he laid waste to the lands of Scottish nobles who supported the English kingââ¬â¢s claim to rule Scotland. In 1309, Robert the Bruce held his first parliament. Bannockburn and Border Raids Over the next few years, Robert continued to fight against the English, and was able to reclaim much of Scotlands land. Perhaps his most famous victory of all took place at Bannockburn in the summer of 1314. That spring, Roberts younger brother Edward had laid siege to Stirling Castle, and King Edward II decided it was time to move up north and take Stirling back. Robert, upon hearing of these plans, rounded up his army and moved into position above the marshy area that surrounded the Bannock Burn (a burn is a creek), intending to stop English troops from reclaiming Stirling. The Scottish army was thoroughly outnumbered, with an estimated five to ten thousand men, compared to an English force of more than twice that size. However, despite the larger numbers, the English were not expecting to encounter any Scottish resistance, so they were caught completely by surprise in the narrow, low-lying area of the marsh, as Roberts spearmen attacked from the wooded hillside. With English archers at the far back of the marching formation, the cavalry was rapidly decimated, and the army retreated. King Edward is said to have barely escaped with his life. Following the victory at Bannockburn, Robert grew bolder in his attacks on England. No longer content to just wait around defending Scotland, he led incursions into the border regions of northern England, as well as into Yorkshire. By 1315, he had attacked English troops in Ireland, at the request of Donall ONeill, the king of Tyrone, one of Gaelic Irelands eastern kingdoms. A year later, Roberts younger brother Edward was crowned as High King of Ireland, temporarily cementing the bond between Ireland and Scotland. Robert attempted for several years to bring about an alliance between the two countries, but eventually it crumbled, as the Irish saw Scottish occupation as no different than English occupation. The Declaration of Arbroath In 1320, Robert decided that diplomacy rather than military force might be a viable method of asserting Scottish independence. The Declaration of Arbroath, which later served as the template for Americas Declaration of Independence, was sent to Pope John XXII. The document outlined all of the reasons that Scotland should be considered an independent nation. In addition to detailing the atrocities committed upon the countrys people by King Edward II, the declaration specifically said that although Robert the Bruce had saved the country from English dominion, the nobility would not hesitate to replace him if he became unfit to rule. One of the results of the declaration was that the Pope lifted Roberts excommunication, which had been in place since he murdered John Comyn in 1306. Some eight years after the Declaration of Arbroath was sealed by more than fifty Scottish nobles and dignitaries, King Edward III, the fourteen-year-old son of Edward II, signed the Treaty of Edinburgh-Northampton. Although there has been speculation that his death was caused by leprosy, there is no evidence to indicate that he suffered from the disease. Western University anthropology professor Andrew Nelson studied Roberts skull and foot bone in 2016, and concluded: The anterior nasal spine (the bone support around the nose) in a healthy person is teardrop-shaped; in a person with leprosy, that structure is eroded and almost circular. King Robertââ¬â¢s nasal spine is teardrop-shaped... In a person with leprosy, the end of th[e] metatarsal bone [from the foot] would be pointed, as if inserted into a pencil sharpener. This bone shows no sign of ââ¬Å"pencilling.â⬠After his death, Roberts heart was removed and buried at Melrose Abbey, Roxburghshire. The rest of his body was embalmed and interred at Dunfermline Abbey in Fife, but was not discovered until construction workers found the casket in 1818. Comparing Story Openings of Bleak House by Charles Dickens to The Outsi
At the opening of the story 'The Outsider', the writer Albert Camus places time in the wrong order. This creates the impression that we are seeing into the character's thoughts rather than a story being told to us. It works very effectively as the paragraphs are spontaneous and not in any form of order, thus creating a mental picture in our heads of one or two day?s worth of events, as if we were remembering them ourselves. This, however, does not apply to Bleak house. Dickens does not use any form of time, but instead decides to describe what is happening and makes the days, time, week or month irrelevant. It could be any day, but Dickens does not want time to be the focal point of his story. This is effective because our interest is drawn to the descriptions and happenings of the city. Surprisingly, both story start with short, improperly composed sentences, most of the time with little or no verbs. This works differently for each story. In ?The Outsider?, the short, blunt sentences arouse interest that forces you to continue reading, this is because the ?thoughts? of the character are rather cold and blunt about a situation that should be upsetting, for example ?Mother died today. Or, maybe, yesterday?, as the opening paragraph. The punctuation break up the sentence into emphasized words. Camus directs us to feel slightly disturbed by his descriptions of the events taken place and puts us in the position of psychologist, eager to hear what comes next, but wary of it also. In ?Bleak House? the short, improper sentences create a very descriptive picture of a cold, dark city, the blunt words mimicking the blunt feelings and people in the city. This is very effective as he uses the same words over again to emphasize the poin... ...he Chancellor and Chancery both being the cause and the centre of the fog, paralleling the weather with the situation. Fog is not a good thing in the court of Chancery and the narrator describes the Chancery as having a dark and unclear vision. They are not good at their jobs and the narrator calls the old Chancellor as being ?leaden-headed? or ?stupid? to emphasizing his views on that particular character. Both story openings, although composed differently, draw the reader in. Both author?s, Albert Camus and Charles Dickens, use a variety of techniques, which are all very effective when the author uses them to his will. Either way we get a clear and pointed view of the spot-lit aspects that the author wants us to focus on, and maybe sometime miss the subtle, important information between the lines that are not the centre of attention at that moment in the story.

There is an age old question that goes like this: Are individuals made to be a leader or are individuals born to be leaders? JoAnne Ciculla, a professor in leadership and ethics program at the Jepson School of the University of Richmond states the question should not be, what is leadership, but what is good leadership? (Giampetro-Meyer, Brown, Browne, 1998). Ciculla referenced three types of leadership: transformational, transitional, and servant leadership. While these are just a few, with leadership, you have to be willing to take charge and direct others.
